sandintoes, Before arriving at a conclusion, it would be necessary to see the results of Patrick Kennedy's toxicology screen. If Ambien is detected in that toxicology screen, such could play a role in his state of mind and behavior at the time of his motor vehicle accident.

Getting back to basics, only a fool would drink and then get behind the wheel. Only a fool would take a sedative and then get behind the wheel. Only a bigger fool would do both. - Holly

I know, but his excuse was the Ambien and another prescription drug that he should not be driving after taking. So why would he get off the hook if his cockamamie excuse were true, but not if he were drinking?

I think he should not get off for any reason, save trying to avoid hitting a child or a dog or something.
