It depends. From what I understand this would be the case if a WIRETAP was desired for domestic internal calls.

HOWEVER, it's not required if one end of that conversation is outside the US.

Furthermore, this whole recent flap is NOT about wiretapping authority, but whether the NSA should be permitted to have access to telecom databases that would provide them the ability to rapidly figure out how far a suspected terrorist connection goes (caller A outside the US calls caller B inside the US.. And we want to know who caller B is calling and so on, so we can know the extent of the full associated network).

Suppose it's a Mafia case. And some of those Mafioso may have connections to the Sicilian Mafia. Do you still get to ignore the Constitution?

Has the Congress passed an authorization to use force against the Sicilian mafia? No...

Thus, the answer to your question is also no.. Mafia organizations would fall under traditional law enforcement, not national defense (which falls under the CinC).

It's important to segregate surveillance conducted as a criminal investigation versus surveillance conducted as part of the National Defense.

So if you're a threat to the national security of the US, then maybe you should move to Canada.. Otherwise, you probably don't have anything to worry about.
