Doug, Intel's presumed use of high-k will solve leakage to a large extent (I mentioned low-k, but that was a slip of the mind). High-k is difficult to do. No other company than Intel goes for it at the start of the 45nm node that I know. Intel might have solved the manufacturability (yield) problem partly but with what little I know I guess that Intel's high-k might still yield lower than the alternative conventional low-k solution that others incl AMD chose. Because of the presumed very different techniques for 45nm this can turn out to be a large differentiator. If Intel managed to make high-k work well without the problems that the others are having with it this can potentially rock the entire industry, AMD first.
