Amendment IV

The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

That does NOT make the distinctions you need. If the question is monitoring calls one of which is in a foreign country, I see no problem. If noth ends are in the UJS, you need a warrant. Period.

Or do prefer simply trashing the Constitution?

Between Bush's failed attempt to calm the immigration waters tonight and this, you had best get ready for a revolt in November. And that may mean an impeachment or two.
