I disagree with your suggestion. We already have three branches of government. It's congresses duty to uphold the law. It's the presidents duty to up hold the law and it's the court's duty to uphold the law.

In this case, it's congress's negligence that has allowed Bush to break the law...hundreds of times.

The solution is to Impeach Bush. To do that you need to vote out those guys in the congress who have been closing their eyes to the law breaking.

How and when will your suggestion ever be implemented?

It won't be. Better off to support the impeachment of the unlawful administration. That means supporting congressional candidates that are not republican.
