I've been following that story for some time.
The claim is that they paid their class representatives millions to be the lead plaintiff(s). The government went
after the plaintiff, too.

Unusual to indict a firm or company itself on this
type of charge.

An element of their defense will be that no one was harmed.
They pursued the cases vigorously and merely shared their
fees, assuming that what is claimed actually occurred (which, of course, it did).
