Of course that's the criteria to be used. But when it comes to the right wing, they are not even investigated for their crimes. In the case of Jefferson, the FBI is directed to search his home. Who made the order to do that?

You can't be charged if you're not even investigated. The rightwing is holding most of the cards on investigations...of themselves. Handy indeed.
