Michael Moore will win. I remember the clip and do not think the vet was portrayed as anti-Bush at all. I believe the jury will see it that way. The vet was just struggling with neurological problems from his war wound. It was what it was. Moore did not say the guy was anti-Bush nor even anti-war. Trial lawyers will be given a pass on this one by the rightwing, no doubt, just as they were then Tom Delay hired trial lawyers to sue after his father's injury, then unplugged him from life support without a congressional investigation.
