I read a way old article a year or so ago written by Alien that said they would not be infringing on the IN patents. I had Assumed the FSA was that technology. If it doesnt work, or doesnt work without IN patents, I guess they are just trying to get some concessions based on the fear that they might work. If they don't work yet, but are likely to, then maybe they are just making sure the patent coast is clear before spending a bunch more money in development. They know that IN will come after them when they finish anyway, so they might want to set the stage rather then letting IN do so. Who knows, maybe the litigation would be done BEFORE they actually had it working correctly.
