You have a great idea. If a case is taken on contingency, the plaintiff could be liable for treble damages payable to the defendant based on the highest derived hourly rate they have received in any case, times the number of hours the defending attorneys bill in the frivolous case. It of course would have to trigger automatically, because it would be so punitive that no judge could ever rule to apply it.
