Of course, Nokia got some of its IP into those standards, and also proposed a WCDMA standard that it thought would circumvent QCOM IP. Even if QCOM ceased selling WCDMA chipsets altogether, it would still get royalty revenue. But that's a worst case scenario. The more likely result is that QCOM and NOK will renegotiate their agreements long before 2007, and that QCOM will benefit because it holds most of the trump cards (i.e., essential IPR).

Does Nokia have IP in CDMA? In the event of a nuclear option, could QCOM simply refuse to allow Nokia to use the QCOM IP in WCDMA or are they obligated to simply charge FRAND royalties?

Nokia clearly believes that a court would mandate a better(lower) royalty rate than QCOM. But a court would also mandate that Nokia pay for the QCOM IP used in GSM EDGE/WEDGE etc.

I guess everyone is taking a long look at the cards. It seems to me that CDMA remains QCOM's best option in a total meltdown-- which, again, everyone agrees is quite unlikely. I think it is also relevant that QCOM has not agreed yet to license any of their Flarion/WiMax IP on unspecified "FRAND" terms. ///jay
