Further, the powers of the federal judiciary are not limited to interpreting the written words of the Constitution nor the written words of the legislative nor the written words of the Executive branch.

In effect this indeed the case. Even in theory the different possible meanings of the words would be considered in the light of the common understanding at the time, legal tradition, apparent original intent etc.
