Another 4-1-4 decision with Kennedy in the middle.

If Congress isn't satisfied with the way the case came down, easy enough to rectify -- after all, if Congress can regulate purely intrastate marijuana use, they can regulate purely intrastate land use -- and water that percolates through soil into tributaries of interstate waterways bears a stronger connection to interstate commerce than smoking homegrown dope in your own house.
