You do come up with very interesting cases. That one is a great read. It shows the extent of scamming that takes place in the industry. It has all the players acting scammy, from the company, the Naked Shorts (not necessarily "illegal" but "manipulative" shorting per court recitation of the facts), and a plaintiff who had less than "clean hands."

I wouldn't put a lot of precedential value in the case because of the fact pattern involving the plaintiff. You had a plaintiff who bought some shares before the manipulative activities and then bought more shares after learning of the manipulative activities.

Interesting to show the extent of the scam, but not necessarily useful as guidance as to liability or damage computation.
