You left out the salient part: how does the publication change this?

What you've laid out is the general rationale for doing Swift in the first place, which makes a lot of sense to me. You haven't presented how the Times publication changes number 2 from "will be intercepted" to "would have been intercepted...and thus not traced." You've drawn a conclusion based on something or other that you have not put into evidence.
