The 1950 amendment to the 1917 Act clearly covers this situation.

The only question is, does the Administration have the political will to prosecute the Times. Doing so would provoke a firestorm in the media. At this point, I think that would be a good thing.

Several days ago, I was listening to Radio - NPR's On Point, I believe. The show is moderated by a guy named Tom Ashbrook, who appears to be an unrepentant liberal. One of the guests made the statement that the First Amendment essentially trumps all other concerns. That kind of arrogant, muddled thinking on the part of the press needs to be addressed, otherwise the media are going to continue to take steps to damage our national security interests.
