What Goes Down ...

L,

<< EL - what chance is there that the Q wins all of these cases around the globe? Lose one and it seems there is a major problem. >>

It is MY opinion that most will be settled by negotiation. Most court settlements probably won't take place very soon. If a court decides against QUALCOMM they'll appeal -- and vice versa. The cloud will hang and that's a negative, but if tech gets a little mo probably so will the sector, and so will QCOM. Along the way -- buying opps. I don't think it'll see its 52 week low but if it does I'm backing up my wheelbarrow, and you might consider doing the same thing.

<< We used to think that Q had the key enforceable patents that seems to be unraveling fast. >>

They do and nothing has unraveled yet. Companies don't like paying licensing fees and royalties but QUALCOMM has a patent portfolio and business model and roomful of negotiated licenses to die for. Its bulletproof. Will they have to give a little? Maybe. Can they afford to? Certainly -- if necessary.

<< How did things turn around like this from six weeks ago? >>

Is the market rational or is it irrational?

I dunno. I happen to think it is more rational than people give it credit for. and we ALL know that the Nasdaq (and tech in general) is highly volatile. is seasonal (some sectors more than others), is cyclical (some sectors more than others), and it often "corrects" and restores some semblance of order even as bulls and bears battle behind the scenes for control.

Tech got ahead of itself. Sector got ahead of itself. QCOM got ahead of itself. We are entering the dog days when all are usually down and there is usually more good news than bad cause there isn't much real news to begin with.

As Sir Irwin Mark Newton or whoever that guy was that got hit on the head with the apple at the cocktail party once said ...

"What comes down must go up"

... or something darned close to that.

Have some wine. I want your QCOM glass to always be at least half full and never half empty.

Best,

- Eric -
