What the critics of the clandestine operations are saying that taking the Congress into confidence is politicizing the issue. Secret surveillance of Americans need to have an independent and non-political oversight by the Judiciary. The legislative branch has already given the power to the judiciary for independent oversight via the FISA law. The law is above everyone else including the President. If you start to refocus on these values, it would become very easy for you to recognize that Bush is trying to change the law unilaterally, something which is very contrary to the "Checks and Balance" value.

The basic US value of "Checks and Balance" is above everything else including the threat posed by the terrorists. Osama and his folks do not believe in this and want t solve everything whichever way they can. And Bush's actions are very similar to Osama's. I call it the "Hook or Crook" approach.
