The courts with the appeals process seems to work fairly well, and I say that even after having been a RMBS stockholder for many years. I agree that the further up the court tree, the more rational the decision. But even the Supremes have made some silly decisions when it comes to patents because they didn't 'get it'. They were mentally tied to misconceptions. (Interestingly I'd guess part of the reason for the improved decisions is the increasing intelligence as you move up, but also that there are fewer arbitrary rules that they feel they need to strictly obey.)
