Just because a policy doesn't work, it doesn't mean it was necessiarily a bad policy -- it could also mean that it is being undermined by competitors who would prefer to see the US fail for their own nationalistic reasons. Maybe a better prez could have done better, I don't know. But I'm pretty sure that neither Gore nor Kerry could have succeeded, either. In fact, I pretty sure their efforts to do anything would have been disastrous.

The legal answer to that would be that you just assumed two facts and conclusions not in evidence. Could be, maybes, they all come down to assumptions and biases in the end.

You can measure whether or not a policy succeeds in achieving its aims. Unless you can quantify and prove causality from the competitors you assume, that too is another assumption.
