I tend to think the INS had to have something greater than just wanting him to spy to deport him. You have to go through a number of proceedings to remove someone's greencard and toss them out of the country. The ACLU would be all over this. Such things are the fodder of activists and the press in the US (hence the WSJ article, typically supportive of the Bush administration..) We are not a police state yet. The way my friend was approached was within the law but he read between the lines and decided it wasn't worth the hassle to continue living in the US. (He had been very seriously thinking of leaving anyway..)
