Why do we need to talk about "what we're trying to accomplish in having tribunals in the first place"?

Why do we need to charge the prisoners with something, and try them? What are we trying to accomplish? What facts are we finding and what law are we dispensing? And why?

If we just discuss how the tribunals will work, we're skipping a step. That step may be implied but I think it should be explicit. It's too important an issue for different people to be inferring different things about it.

In your zest to find the perfect tribunal, did you skip a step or do you think that step is just too obvious to require articulation?
