I may be wrong but I am pretty sure I recall that the Red Cross was not allowed private interviews with Gitmo detainees, which is standard procedure for Red Cross visits anywhere, an interview where the detainee cannot be intimidated by the capturing party.

No, we don't have the unilateral right to define who is and is not a "combatant" in a "war."

It's true that we are now the hegemon, for good or ill, mostly because we're dumb enough to spend all our money on the Pax Americana so the others let us do it.

But we are intertwined with every other nation for exchange of trade, for exchange of culture, for exchange of ideas, for exchange of persons, and thus, we must abide by the rules of international law, especially the treaties we've ratified, which are the law of the land pursuant to Article VI of the Constitution.

The people who earnestly argue that we don't need no stinking international law are dumb yahoos. Most of them, the ones who really believe it. The intelligent ones like Scalia are being disengenuous, because it's clear as crystal that the opinions he disputes look to international law as inspiration, not as binding, except for treaties, which are by their nature binding.

I love Scalia but he's a humbug when he doesn't get his way, and sometimes when he does. Don't let him fool you.
