It wouldn't be so difficult if you would accept the concept that "due process" is considered a fundamental human right. You don't have to agree with that, although I suppose you do.

If they're entitled to a status hearing -- and they are -- then they're entitled to due process at that hearing.

As you say, we've been through this.

Allegations that the SCOTUS ruled that "a third party must determine their status" and "they must be released immediately" are totally extraneous to anything else you and I have discussed, and I have no idea where they're coming from. Maybe Rush Limbaugh says that's what it says, or O'Reilly, or Joe Farrah, or who knows?

It's quite the vogue to say things like that, and who's to know who's right, Rush Limbaugh or Justice Stevens? (sarcasm)
