As I understand it, all this talk about "necessary" vs. "essential" is completely irrelevant at this point, since the WCDMA spec is now standardized. To extend your analogy, it would be as if there were a law saying that only automobiles with a certain ashtray style were allowed on the road. Like it or not, anyone who wants to sell a car needs to use the Nokia's particular ashtray, and either pay them for it, or strong-arm them into giving up their ashtray patents for free.
