Delphi creditors aim to use SEC probe data in GM suit

NEW YORK (Dow Jones/AP) - Delphi's creditors are considering a billion-dollar lawsuit against General Motors and several former Delphi executives.

The creditors say they plan to use confidential information obtained from a Securities and Exchange Commission investigation to prepare for legal action.

The creditors are asking a federal bankruptcy judge in New York for permission to sue GM, which spun off its parts-making operations in 1999 to create Delphi. They say Delphi sustained billions of dollars in damages in the spin-off.

Delphi now is in Chapter Eleven bankruptcy proceedings.

A spokeswoman says Delphi opposes such a suit.
