We're clear. That's a very sad story. In California that wouldn't happen. Our statutes are fairly protective.

The roughneck victim (Joseph Oncale) wasn't gay. Though the guys who sexually harassed him and threatened to rape him might have been - their behavior is pretty weird for heterosexuals.

The case didn't have to do with homosexuals or homosexuality but same sex sexual harassment. And I think he won at the SC level - that is I think the SC ruled same sex sexual harassment can exist and is actionable.
