The roughneck victim (Joseph Oncale) wasn't gay. Though the guys who sexually harassed him and threatened to rape him might have been - their behavior is pretty weird for heterosexuals.

The case didn't have to do with homosexuals or homosexuality but same sex sexual harassment. And I think he won at the SC level - that is I think the SC ruled same sex sexual harassment can exist and is actionable.
