Its not a lack of any check, the machines can be audited. If the concern is severe than I have no major problem with changing the procedures again, but I do have a problem with using the existence of these machines to assert that the elections in the US aren't essentially free and fair. These machines addressed some concerns from previous elections, and might raise some concerns themselves. If the concerns are important enough than go ahead and address them but there will always be new ones.
