A more important point is that they run the risk of having any evidence or leads acquired this way to be disallowed in court.

In general the kind of information in a national security case doesn't lead to a trial anyway. The important thing is to get it stopped. The FISA is a good process for that. Going around FISA is a way that leads to police-state abuse.
