NY Times reports federal prosecutors in Brooklyn are preparing to bring charges against former CMVT execs, including possibly CEO Jacob Alexander, in the next two weeks or so, a person close to the investigation says. Prosecutors are likely to build a case on whether the execs made misleading statements to the board and to its auditors, another person briefed on the investigation said. Last month, prosecutors in San Francisco charged Gregory Reyes, the former chief exec of Brocade Communications Systems (BRCD), and another former exec with one count of securities fraud each and accused them of doctoring records. A case against CMVT could show how the stakes are rising for everyone in the exec suite, particularly if prosecutors press charges against the former chief financial officer, David Kreinberg, as well as the co's former in-house lawyer and longtime corporate secretary, William Sorin. Both execs and Mr. Alexander resigned three months ago. A case against the former CMVT execs would also show that prosecutors are picking up the pace in their investigation into charges that options were manipulated at a number of cos.
