What I can't understand is that XM should have hired an independent FCC test site for this equipment to have it checked out. Of course they had to have it tested to get an FCC ID before they were able to sell it. However since the suit regarding the FM modulator, what has changed in the spec now that they failed the test?

including the chronology and circumstances leading to the non-compliance, and actions and remedies undertaken to correct the situation.

This would appear to be a very important line given SIRI's admission of intentional disregard of the regulations. They're wanting to know whether XM did the same.

We could be looking at some kind of sanctions against the offenders.
