I agree with you and others that the folks who invested in the QQQ's based on the newsletter don't have a case. I wonder if the people who invested in the BJ group might have legal recourse. I remember an advertisement at the BJ group's website that stated that they did not engage in short term trading. People in the BJ group were put into the QQQ's and it was intended to be a short term trade. I see the essence of their case being that they were placed in a high risk trade when they were assured by the BJ group that the company does not engage in this type of activity.
