Whether or not Qualcomm actively participated in 3GPP technical meetings ... or attended the meetings at all ... is actually irrelevant. As an ETSI Full Member (or even if it were an Associate Member), Qualcomm is obligated "to inform ETSI of ESSENTIAL IPRs in a timely fashion." etsi.org (Para. 4.1)

My earlier link proves that Qualcomm -- via AFFILIATE Qualcomm Europe S.A.R.L. -- was an ETSI member at least as early as Sep 2000.

Even if Qualcomm Europe had just joined ETSI in Aug 2000, Qualcomm was likely obligated to disclose IPR essential to standards -- both released and in development -- in a "timely fashion" after becoming a member. Were all Qualcomm's IPR declarations relative to GPRS and EDGE "timely?". I surely don't know but suppose that's what the legal suits will determine ... if Qualcomm and Nokia don't settle first.
