Sorry Jeff,

Those shares are not in "Common stock" and have nothing to do with the FTD's in the system - guess again.

Why not start sticking to facts...

1. What trades in the market? Common stock
2. How many shares of Common stock were there? 1.1 Million on Feb 1, 2005; 4 Million on March 31, 2005; 4.8 Million December 30, 2005
3. How many fails reported post "when issued"? 10 million.
4. What comprises that list? Common Stock only as that is the ONLY stock trading in the markets.

Now read the edgar filings of 2005 and do the math. Only Common stock trades under a CUSIP, all other stock is restricted and the SEC would have taken action idf sold. you are chasing a red herring and diverting from teh real issue.

You forget, I agree this was not naked shorting, it was a market gaffee the SEC allowed to continue. Now crawl back under your rock.
