No, you go to the FISA judges and give them probable cause. You don't have to divulge anything to the public if YOU GO TO FISA. If he could go to FISA then he would have.

Obviously he couldn't go to FISA and the question is WHY? The obvious answer would be because he did not have probable cause because he did not have enough information or because his target wasn't proper.
