It is a a reasonable assumption for a non-attorney. However, I assume, as an attorney (allbeit no longer practicing), that the legislation was engendered BECAUSE there was no adequate redress under existing law (constitutional remedies included). I, too, could be wrong about this. Sometimes politics just drives the train.

What we really need here is the opinion of a constitutional scholar who has stayed current on developing case law. As time permits, I may be able to get an idea of the trends off of some of the legal sites on the internet. It will not be a priority with me however--so it may be a while.
