Estoppel is an affirmative defense, and was required to have been plead by Nokia at the time of its first responsive pleading, or it would have been waived. Many unmeritorious affirmative defenses are often plead, to assure they are preserved. However, Nokia will have the burden of proving estoppel; and, those who assume Qualcomm wasn`t aware of, or failed to properly discharge its duties of timely disclosure, are nothing short of naive.
