I think the courts have been far to accepting of "civil forfeiture". It amounts to guilty until proven innocent. Yes its not officially considered a criminal punishment, but slapping the label "civil forfeiture" on the action doesn't change its essential nature. Its either a punishment for an alleged crime (in which case it should require proof beyond all reasonable doubt) or its a taking (in which case it would require compensation, and since this was cash the compensation would basically be giving the same cash back.
