Understood, but I don't see the need to sprinkle the words "alleged", "allegedly", and "allegation" throughout posts in this informal forum. We're talking about lawsuits in progress, and the context should be obvious to most, if not all. "As between Nokia`s aggressive pleading ploy, and an assumption that Qualcomm was ignorant or inept in their conduct and/or communications, until/unless proven otherwise, it is the former." I believe you already told us "Nokia will have the burden of proving estoppel."
