but reasoning from the transportation cases I see all businesses as regulable I don't think RMF's concern is about how the regulations fit in with various judicial decisions. Certainly mine is not. If courts had declared something similar unconstitutional than certainly there would be more ammunition against the nanny state, but even if the actions are fully constitutional that doesn't necessarily make them desirable or keep them from being a reduction of personal freedom.
