We are at war to support the government of Iraq. A nation that's government is currently in the middle of a conflict and that depends on the presence of American forces for its continued existence might reasonably decide to let the Americans prosecute their own crimes. Its not shocking or unusual for a country in Iraq's situation to agree to such an arrangement.

We aren't at war with Iraq, but we are at war in Iraq. I don't think that the French prosecuted Americans for crimes while the Americans where still fighting the Nazis in France.

If the war basically ended, but we kept some small amount of American soldiers in Iraq, then the Iraqi government would probably want to sign a status of forces agreement more along the lines of agreements the US has with other nations. The US military might keep custody until an indictment, some protections for the rights of Americans might be put in to effect, but the Iraqis might then be able to prosecute Americans. But we haven't reached such a stable situation. I imagine you think we will not reach such a situation.
