Locking up enemy combatants isn't about proving guilt of anything. We didn't and didn't have to prove that the German and Japanese and Vietnamese, and Korean, and Chinese, and Italian etc. etc. soldiers we captured in previous war where guilty of anything.

Which doesn't mean I'm opposed to giving someone a chance to present evidence that the capture was a mistake if there is any reasonable doubt that it was. But you don't give enemy prisoner full jury trials.
