I think from a logic point of view that the person doing the using is the one who is most likely to know that they are doing something.

There are hordes of other technologies and companies. To know somebody else is doing something with one's intellectual property would take investigation after realizing that that's what might be going down.

For example, Al Qaeda was in a better position to know that some aircraft were going to hit the Twin Towers. The FBI might know and did know that they were evil-doers, but one can be busy with other things and not notice the lead up.

A bank robber can't be caught until he robs and while it's obvious that he might like to rob a bank, there are lots of banks and lots of potential bank robbers. Crooks always have the initial advantage. IPR crooks do too. It's only if anyone notices that they might have to pay up or stop.
