You're right. I was very tired last night and did not read the last paragraphs carefully after going through the good stuff. There seems to be a media buzz concerning the fact that the entire case was dismissed without prejudice, which is wrong and needs to be corrected. The complaint which was dismissed was an amended complaint. I assume it was amended because the first one was problematical. It therefore probably represents BRCM's best effort to state an antitrust claim. I understand very well what the judge did. Deal [am dealing] with this kind of stuff all the time.
