The District Court is Federal Court. An appeal should take at least a year, during which there can be no Discovery. Most appeals fail.
More likely, Broadcom will try to manipulate allegations to mimic the Rambus ITC action, will make a big headline splash about "Qualcomm`s abuse of the standards process", and will fail again. (Broadcom has a history of aggressive litigation, at the end of which it has not only lost, but has had to pay the parties it sued millions for the privilege.) In the meantime, the market may wrongfully price Qualcomm for "worst case" eventualities, and Broadcom will be without a UMTS/HSDPA license. Gonzo litigation has a downside.
