i'll have to share this mediation story with kathleen. we're meeting up for lunch today.

the best thing about mediation is that it ends in a win-win solution. sometimes the parties may feel it's a lose-lose ending but even that is ALWAYS better than a win-lose result.

JUSTICE FOR ALL is an important human need to fill and revenge does not fit into the equation.

a view of boston harbor all day... a big financial hassle solved... and chocolate pie with A20. i'd guess that makes for a pretty satisfying way to celebrate the beginning of your 62nd orbit.

I've participated in dozens of construction mediations, though never as the mediator; you've described to a "T" what my experience has been as well with regard to the successful mediation process.

The mediator said a successful outcome to a mediation is when all the parties are dissatisfied with the outcome, but deep down know it was fair and realistic.

I've often heard that a fair settlement is one that leaves everyone a bit uncomfortable. From a mediator's perspective, that's probably a good rule of thumb. From a lawyer's perspective, the client had better be satisfied with the outcome on some level or the lawyer will hear about it again in less pleasant circumstances. <NG>

Good for you for resolving your dispute. I guess that made for a happy birthday indeed.

That's a great story with many lessons built in !!

I think that violence erupts when civilization has failed...................and that includes all wars. Wars represent the total meltdown of civilized society.

It's easier to go in with guns blazing ( having a brawl )and kicking butt.

I am not an advocate of the " Kick Butt" style of diplomacy. The party with the kicked butt often gets even through the back door.

This country has spent billions building up their stockpiles of "Kick Butt" weaponry but have ignored the means by which others can "get even".

The NNBM is a better problem resolver!
