no record company or RIAA has ever sued bittorrent- not even once. they have sued tracker sites, but never the company itself (bram's company)<<

Bittorrent is not the same as P2P software. In itselft it's no more a tool for piracy than FTP is. As you point out, the tracker sites, which do facilitate piracy, have been sued.

But go ahead and believe what you want to believe. If you choose to insist that Microsoft is going to build promote a product that actively encourages copyright violation, I can't stop you. The facts are not yet in, as even Microsoft's own fact sheet is vague, but I don't believe you will be able to share files that don't have DRM attached.

When Zune is released, or Microsoft clarifies the rules for sharing we'll know. If I am shown to be wrong at that time, I'll gladly admit it.
