The SCOTUS says they MUST have status review. That was at least two years ago. That doesn't add to the list of possibilities, it just means that we aren't going to use one of the options on the list. So now your left with 1 - Don't capture anyone just shoot them. (For future potential captures) 3 - Put US assets at risk. 4 - Let them go even though we know, or at least have very strong reason to think, that they are enemy combatants. Or of course allow secret evidence to be used. Which one do you pick?
