There are already rules for POWs using military tribunals and for evidence. What we are talking about here are the rules for non-POWs, aka "unlawful combatants".

As we already know many of the guys the U.S. grabbed were innocent and they have been released without charges. So mistakes have been made - and will be made again in the future. Therefore it is imperative to give these guys a chance to prove their innocence - just like you and I would want if we were in their shoes.

Why not just use the existing POW rules for these guys? If they are caught in the U.S., I'd use the U.S. court system.

Imagine if we caught Bin Laden - something we all hope will happen. I'd like to see him tried publicly. If we have the evidence (and I think we do), giving him a fair and public trial would be the worst thing for his cause - and the best thing for our cause. A triumph of the Rule of Law and America.
