it is that simple ted... adding irrelevant material doesn't change my original contention the Connecticut and Arlington cases are not related in any way though your ABB or BDS has you seeing it that way. Adding irrelevant material? When did the development agreement become irrelevant? Its the contract between the city and the developer....like a lease or a mortgage.
